加利福尼亚州萨克拉门托地区法官 Daniel Calabretta 第二次驳回了共和党全国委员会（RNC）对 Google 的诉讼，要求不得再提起上诉，法官认为 RNC 没能充分证明 Google 违反了加州的不正当竞争法。RNC 指控搜索巨人将它发送的邮件归类到用户的垃圾邮件收件夹，认为这是歧视，是基于政治派别和观点过滤其邮件，称在选举筹款的关键时刻，它的数以百万计的邮件却被归入潜在捐赠者和支持者的垃圾邮件收件夹。Google 否认了指控。RNC 称它的邮件在一个月的大部分时间内并没有归类，而是正常出现在用户的收件箱，但到了月底邮件全部进入了垃圾邮件文件夹。Google 表示它并没有根据政治派别过滤邮件，Gmail 的垃圾邮件过滤器反应的是用户行为，它否认有任何不当行为。
